Terms and Conditions (T&Cs) of FocusControl<\/h1>\n

Effective from January 1, 2008<\/strong><\/p>\n

1. Scope of Application<\/strong><\/h4>\n

These Terms and Conditions (T&Cs) govern the contractual relationship between FocusControl (hereinafter referred to as \u201cFocusControl\u201d) and its customers (hereinafter referred to as \u201cCustomer\u201d). The T&Cs are an integral part of every contract between FocusControl and the Customer.<\/p>\n

2. Offers and Prices<\/strong><\/h4>\n<\/p>\n
    \n
  • Prices stated in offers and order confirmations are generally binding. However, errors and changes remain reserved.<\/li>\n
  • All prices are quoted in Swiss Francs (CHF) and include value-added tax (VAT).<\/li>\n<\/ul>\n
    \n

    3. Delivery Terms<\/strong><\/h4>\n<\/p>\n
      \n
    • Delivery Regions:<\/strong> Deliveries are made within Switzerland. Deliveries to other countries are available upon request.<\/li>\n
    • Delivery Time:<\/strong> Items in stock are usually dispatched within two business days. Delivery delays do not entitle the Customer to withdraw from the contract or claim damages.<\/li>\n
    • Shipping Costs:<\/strong> Deliveries are made at the Customer’s expense and risk. Partial deliveries are permitted unless otherwise specified by the Customer. Shipping costs are typically charged once per order.<\/li>\n<\/ul>\n

      4. Payment and Retention of Ownership<\/strong><\/h4>\n<\/p>\n
        \n
      • Payments are accepted exclusively in Swiss Francs. Invoices must be settled within 10 days of the invoice date. Discounts are not granted.<\/li>\n
      • In case of late payment, interest on arrears is charged according to standard bank rates.<\/li>\n
      • Delivered goods remain the property of FocusControl until full payment is received. Configuration and programming services also remain the intellectual property of FocusControl until the invoice is paid in full.<\/li>\n<\/ul>\n

        5. VAT and International Orders<\/strong><\/h4>\n<\/p>\n
          \n
        • For orders outside Switzerland, prices are displayed excluding Swiss VAT.<\/li>\n
        • Customs duties, destination country VAT, and import costs are the responsibility of the recipient.<\/li>\n<\/ul>\n
          \n

          6. Warranty and Liability<\/strong><\/h4>\n<\/p>\n
            \n
          • FocusControl guarantees factory-new products in original quality.<\/li>\n
          • Warranty claims are subject to the manufacturer\u2019s terms. Unless otherwise specified, the warranty period is 24 months.<\/li>\n
          • For irreparable or unavailable products, an equivalent replacement will be provided without an extension of the original warranty period.<\/li>\n
          • FocusControl excludes any liability for direct or indirect damages, malfunctions, or improper use.<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div>

            7. Complaints and Returns<\/strong><\/h4>\n
              \n
            • Complaints must be submitted in writing within 10 days of receiving the goods.<\/li>\n
            • Returns are at the Customer\u2019s expense and risk and should ideally be made in the original packaging.<\/li>\n<\/ul>\n
              \n

              8. Appointment Cancellations and Changes<\/strong><\/h4>\n
                \n
              • Cancellations:<\/strong> Appointments canceled or rescheduled less than 24 hours in advance will be charged in full.<\/li>\n
              • Rescheduling:<\/strong> Date changes require written agreement from both parties. Fees for changes:\n
                  \n
                • 7 to 3 days before the service date: CHF 450.\u2013<\/li>\n
                • Less than 3 days before the service date: 60% of the service fee.<\/li>\n<\/ul>\n<\/li>\n
                • Cancellations:<\/strong>\n
                    \n
                  • Free of charge if made at least 20 business days before the service date.<\/li>\n
                  • Less than 20 business days to 3 days before the service date: 60% of the agreed fee.<\/li>\n
                  • Less than 48 hours before the service date: 80% of the agreed fee.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

                    9. Data Protection<\/strong><\/h4>\n

                    Customer data is processed in compliance with the Swiss Data Protection Act and used exclusively within FocusControl. Data is not shared with third parties.<\/p>\n

                    10. Jurisdiction and Governing Law<\/strong><\/h4>\n

                    All contracts are subject to Swiss law. The place of performance and exclusive jurisdiction is Liestal, Switzerland.<\/p>\n

                    \n

                    11. Final Provisions<\/strong><\/h4>\n
                      \n
                    • FocusControl is not liable for the content of partner websites; their respective terms apply.<\/li>\n
                    • Liability is excluded for improper use of products. The statutory provisions of the Swiss Code of Obligations (CO) apply.<\/li>\n<\/ul>\n
                      \n
