Terms and Conditions (T&Cs) of FocusControl

Effective from January 1, 2008


1. Scope of Application

These Terms and Conditions (T&Cs) govern the contractual relationship between FocusControl (hereinafter referred to as “FocusControl”) and its customers (hereinafter referred to as “Customer”). The T&Cs are an integral part of every contract between FocusControl and the Customer.


2. Offers and Prices

  • Prices stated in offers and order confirmations are generally binding. However, errors and changes remain reserved.
  • All prices are quoted in Swiss Francs (CHF) and include value-added tax (VAT).

3. Delivery Terms

  • Delivery Regions: Deliveries are made within Switzerland. Deliveries to other countries are available upon request.
  • Delivery Time: Items in stock are usually dispatched within two business days. Delivery delays do not entitle the Customer to withdraw from the contract or claim damages.
  • Shipping Costs: Deliveries are made at the Customer’s expense and risk. Partial deliveries are permitted unless otherwise specified by the Customer. Shipping costs are typically charged once per order.

4. Payment and Retention of Ownership

  • Payments are accepted exclusively in Swiss Francs. Invoices must be settled within 10 days of the invoice date. Discounts are not granted.
  • In case of late payment, interest on arrears is charged according to standard bank rates.
  • Delivered goods remain the property of FocusControl until full payment is received. Configuration and programming services also remain the intellectual property of FocusControl until the invoice is paid in full.

5. VAT and International Orders

  • For orders outside Switzerland, prices are displayed excluding Swiss VAT.
  • Customs duties, destination country VAT, and import costs are the responsibility of the recipient.

6. Warranty and Liability

  • FocusControl guarantees factory-new products in original quality.
  • Warranty claims are subject to the manufacturer’s terms. Unless otherwise specified, the warranty period is 24 months.
  • For irreparable or unavailable products, an equivalent replacement will be provided without an extension of the original warranty period.
  • FocusControl excludes any liability for direct or indirect damages, malfunctions, or improper use.

7. Complaints and Returns

  • Complaints must be submitted in writing within 10 days of receiving the goods.
  • Returns are at the Customer’s expense and risk and should ideally be made in the original packaging.

8. Appointment Cancellations and Changes

  • Cancellations: Appointments canceled or rescheduled less than 24 hours in advance will be charged in full.
  • Rescheduling: Date changes require written agreement from both parties. Fees for changes:
    • 7 to 3 days before the service date: CHF 450.–
    • Less than 3 days before the service date: 60% of the service fee.
  • Cancellations:
    • Free of charge if made at least 20 business days before the service date.
    • Less than 20 business days to 3 days before the service date: 60% of the agreed fee.
    • Less than 48 hours before the service date: 80% of the agreed fee.

9. Data Protection

Customer data is processed in compliance with the Swiss Data Protection Act and used exclusively within FocusControl. Data is not shared with third parties.


10. Jurisdiction and Governing Law

All contracts are subject to Swiss law. The place of performance and exclusive jurisdiction is Liestal, Switzerland.


11. Final Provisions

  • FocusControl is not liable for the content of partner websites; their respective terms apply.
  • Liability is excluded for improper use of products. The statutory provisions of the Swiss Code of Obligations (CO) apply.
